Does anybody have a clue who might be the owner of the copyright or trademark for the ZX80 case (the white housing of the PCB)?
A friend of mine was so kind to create a 3D model of it for 3D printing (near to perfect, not absolutely) but he is afraid of publishing it because of copyright issues. He wouldn't like to be fined because he made it.
When publishing via shapeways, you need to state that you are the owner of the copyright, which he isn't
Anybody having helpful ideas?
Kind regards
Paul
Copyright/Permission for ZX80 Case?

In theory, there is no difference between theory and practice. But, in practice, there is.

Could it still be Sinclair?
Sinclair Research Ltd still exists, see here. ZX80 page here.
Or maybe Rick Dickinson holds the copyright?

Re: Copyright/Permission for ZX80 Case?
Well - just a hint to the german regulations.
Design can be protected through "Geschmacksmuster" only.
The rules: The design has to be NEW and need special aspects to distinguish it from other designs.
The protection is for 5 years, can be extended to 5 more years by paying special fees every 5 years.
The maximum protection is possible for 25 years only.
A new "Geschmacksmuster" is not possible, because after 25 years it is not more new (one of the basic rules).
So if there has ever been a "Geschmacksmuster" for it, it is expired and can not be renewed.
A design can not be protected with a trademark, this can be done for names and slogans only or pictures like logos or combinations.
So the name Sinclair or ZX80 could be a trademark but the reproduction of the case could be done without a name on it.
So there is no hurt of a trademark possible.
If any user wants to put a logo on it he could do it himself.
This has nothing to do with the design or the production data for shapeways.
The regulations are EU wide, a "Geschmacksmuster" can be used either in the local country or in the european union.
The duration of protection is same as in Germany.
More information here:
http://www.dpma.de/geschmacksmuster/faq/
So there can not be an active protection now anymore.

Re: Copyright/Permission for ZX80 Case?
Thanks for the info! That's good news. I will forward this to my friend!
Anyway, meanwhile I have asked Rick Dickinson for his opinion.
Kind regards
Paul

Re: Copyright/Permission for ZX80 Case?
There are no trademarks which I can find for Sinclair or ZX80 in the UK trademark registry.
The copyright for unregistered designs lasts 10 years from when the design was first made available in a product (so ended in 1990) - see
http://www.copyrightservice.co.uk/prote ... ign_rights
So long as you are not copying the original drawings (which have a much longer copyright duration - min 25 years), then I don't see a problem - I would however, advise that minor 'imperfections' are made so that the original and the aftermarket replacement can always be identified - the cases would also have to be sold clearly marked as replacements.

Well, it's definitely not Rick Dickinson. He answered that he designed ZX81 and Spectrum cases, not ZX80 cases that were designed by John Pemberton1024MAK wrote:Could it still be Sinclair?
